WICHITA, Kan. (KAKE) – A 5-month-old Wichita boy has died months after he and his twin brother suffered from abuse allegedly at the hands of their father.
Sedgwick County records show 33-year-old Devin Bemis has been in jail since January 26 on two counts of child abuse. Charges were filed on January 26.
According to a court document, the incident happened on January 21. Bemis is accused of causing “great bodily harm, abusive head trauma, permanent disability or disfigurement” to a child identified by the initials GMB. Grayson Matthew Bemis, who was two months old at the time, died on April 26, the baby’s obituary states. His funeral service is scheduled for Tuesday.
“Grayson was a sweet and precious baby, often wrapped in his favorite Spider-Man blanket, bringing comfort and smiles to those who held him,” the obituary says. “He filled hearts with a kind of joy that will never fade.”
First responders were called at around 1:30 p.m. on January 21 to the report of an unresponsive 2-month-old in the 300 block of South Tyler Road. According to scanner traffic reviewed by KAKE News, CPR was in progress over the phone. When the fire department arrived on scene, they reported the child was extremely critical. He was upgraded to critical a short time later.
Bemis is also charged with abusing a child with the initials ENB, Grayson’s twin brother, according to the obituary.
Bemis’ bond was initially set at $1 million, but it was lowered to $400,000 on February 13. On April 24, Sedgwick County District Court Judge Kevin Smith denied Bemis’ request for the sheriff’s department to transport him for “one last visit at Wesley Medical Center.”
Charges have not been amended as of Monday. A preliminary hearing is scheduled for Thursday.
Judge Smith has also denied a request to release the probable cause affidavit in the case.
